  Hengyang Municipal Population and Family Planning Commission is established as an institution directly under the municipal government, with its main functions, internal structure and personnel management in accordance with the “Notice of the General Office of the CPC Central Committee and the General Office of the State Council on Printing and Distributing ‘Plan on Reform of Organs of Hengyang Municipal People’s Government’” (Heng Wei[2010] No. 4).


I.To implement state guidelines, policies, laws and regulations on population and family planning; to organize the drafting of laws and regulations on population and family planning; to assist relevant departments in formulating social and economic policies to promote a comprehensive approach to population and family planning.
 
II.To study and formulate Hengyang` s population development strategies and, according to the objectives of population control set by the State and the municipal government, develop mid-term and long-term plans and annual programmes for the municipal population and family planning; to make development plans for the municipal family planning initiatives; to handle statistics of family planning, organize provincial sampling surveys on family planning, and participate in the analysis and research of the municipal demographic data.


III.To organize the implementation of the master plan for the scientific research into family planning; to organize comprehensive and prospective studies on major population and family planning issues.
 
IV.To conduct general management over the technical services for family planning; to develop reproductive healthcare programmes and standards with respect to reproduction, birth control and infertility; to assist health departments to implement programmes for healthier babies; to direct and supervise technical services for family planning and the delivery of contraceptives and, in collaboration with the administrative departments for industry and commerce, drugs, and commodity prices, etc., supervise and manage the retail of contraceptives and the market of healthcare products.
 
V.To formulate publicity and education plans on population and family planning, and organize publicity and educational activities on it across Hengyang; to coordinate the efforts of relevant departments in organizing social, non-profit publicity and educational activities on population and family planning.
 
VI.To draft budgets and final accounts for family planning administrative expenses and capital construction at provincial level as well as make needs assessment of contraceptives; to manage financial affairs and state assets of the Commission and its immediate subordinates; to guide the financial management work in the sector of family planning.


VII.To develop and implement programmes for fostering, educating and training the personnel in the population and family planning sector; to manage the staffing of the Commission and its immediate subordinates.


VIII.To oversee international exchanges and cooperation in population and family planning, and manage international cooperative projects in population and family planning.
 
IX.To guide social organizations related to population and family planning.
 
X.To undertake other assignments entrusted by the Provincial Party Committee and People`s Government.

Main Functions
I. to implement laws, rules, regulations, guidelines and policies related to patent; to study and draft local rules, regulations and policies concerning patent and organize to carry them out;


II. to assume the responsibility of drawing up the intellectual property strategy of Hengyang within the limits of its authority together with relevant departments according to the requirements of the overall objectives in the outline of the national intellectual property strategy and the municipality’s overall plan on national economic and social development, and organize to carry it out together with relevant departments; to formulate the municipality’s development program and working plan concerning patent and carry them out;


III. to carry out intellectual property protection in key fields and industries and major special projects of the municipality, and also intellectual property investigation into significant economic affairs with relevant departments; to organize to carry out regional intellectual property strategy within the limits of its authority; to guide and supervise the strategic implementation and evaluation of intellectual property in districts and counties within the limits of its authority together with relevant departments of the municipality;


IV. to strengthen the public service of intellectual property information in the municipality together with relevant departments, take charge of establishing the public service system for patent information in the municipality and promote the dissemination and use of patent information together with relevant departments; to establish the early-warning mechanism for intellectual property together with relevant departments; to guide and standardize evaluation of the intangible assets of intellectual property together with relevant departments; to guide relevant work concerning intellectual property aid and intellectual property arbitration;


V. to study to formulate policies and measures on promoting the application of the patent system and patent technology transformation and implementation, and take charge of the management of patent work in patent technology exchange market and patent license trade; to take charge of patent statistics, analysis and reporting; to assume the responsibilities of accepting patent application, collecting patent fees and inquiring and consulting relevant issues with the authorization or entrustment of the State Intellectual property Office of the People’s Republic of China;


VI. to organize, coordinate and implement intellectual property protection in the municipality and establish the cooperation mechanism in law enforcement of intellectual property and carry out relevant law enforcement work together with relevant departments; to assume the responsibility of standardizing the basic order of patent management, and take charge of overhauling and standardizing patent protection in the market economy and patent protection in exhibitions of the municipality; to take charge of handling and mediating in the cases of dispute over patent infringement, and investigating into and punishing patent imitation and counterfeit;


VII. to organize to publicize and popularize laws, rules and policies about patent and organize to work out the educating and training plan concerning intellectual property of the municipality according to the regulations;


VIII. to draw up the municipality’s policies on foreign-related intellectual property, do research into the development trends of foreign intellectual property, conduct overall planning and coordination in foreign-related intellectual property issues and carry out cooperation and exchange with foreign countries, Hong Kong, Macao and Taiwan;


IX. to guide the development of patent intermediaries in the municipality, organize to formulate administrative measures on standardizing patent intermediaries of the municipality and take charge of supervising and guiding relevant trade associations;


X. to take charge of acceptance and hearing of relevant administrative reviews and responses to administrative proceedings;


XI. to undertake other tasks assigned by the municipal government.

    Hengyang Municipal Culture, Radio Broadcasting, Film and Television Administration is established as one of the departments of the municipal government in accordance with the “Notice of the General Office of the CPC Central Committee and the General Office of the State Council on Printing and Distributing ‘Plan on Reform of Organs of Hengyang Municipal People’s Government’” (Xiang Bian Ban [2011] NO.38 ) and “Suggestion for the reform of Culture System in Hengyang. Hengyang Municipal Culture, Radio Broadcasting, Film and Television Administration is in charge of the culture, radio broadcasting, film and television.


The major duties of Hengyang Municipal Culture, Radio Broadcasting, Film and Television Administration are:


1. To carry out the laws, policies and regulations of the Party and the country in terms of culture, relics and news press; to study and draw up local regulations in terms of culture, relics and news press; to be responsible for the implementation of these regulations after examination; to draw up development plans for the local culture, relics and news press.


2 To implement the trade administration of this Municipality’s culture and arts, radio broadcasting, film and television undertakings; to be responsible for the promotion of key artistic production and art theories research in the whole Municipality; to formulate the development strategy and planning of this Municipality’s culture and arts, radio broadcasting, film and television; to be responsible for the building up of the administrative management, artistic creation and art education of units directly affiliated to this Administration, and for the supervision and administration of state owned assets in the units directly affiliated to this Administration.


3 To be responsible for the verification and appropriation and supervision of the use of the government funds for the development of this Municipality’s culture, radio broadcasting, film and television undertakings; to conduct the centralized administration of major cultural activities at municipal level and the appraisal and administration of government awards in the field of radio broadcasting, film, television and culture and art; to carry out the administration and supervision in accordance with law the frequency and channel resources of radio broadcasting and television, and the planning and construction of cable net.


4 To be responsible for the administration of man activities of culture and art of the whole municipality and mass art galleries, cultural centers, public libraries and the man cultural organizations etc.; to direct and push ahead various cultural work of the mass.


5 To administer in accordance with law the cultural markets including cultural entertainment, performances, art, film and television, audio and video cable net and websites; to be responsible for market access of art products, the examination and approval of the qualification of this Municipality’s organizations related to culture, radio broadcasting, film and television, and the examination and approval of various out-of-town organizations related to radio broadcasting, film and television situated in Shanghai.


6 To be responsible for the acceptance and handling of administrative reconsideration applications and response to administrative actions.


7 To direct and be responsible for and this Municipality’s external exchange in terms of culture and art, radio broadcasting, film and television and exchange with Hong Kong SAR, Macao SAR, and Taiwan regions; on the base of authorization by the State Ministry of Culture to be responsible for the examination and approval of the qualification of foreign-related business of this Municipality’s cultural broker agencies; to administer the cultural, film and television activities organized by foreign diplomatic agencies in Shanghai and relevant international organizations.


8 To cooperate in formulating culture, film and television talent planning of this Municipality jointly with relevant departments; to be responsible for directing and administering the art education; to direct both the administrative work of the culture, radio broadcasting, film and television and development of the undertaking at district and county level.


9. To study and instruct the administrative reforms in the local units of culture, relics and news press; to be responsible for promoting the personnel development in the units of culture, relics and news press, so as to push forward the personnel reform in the cultural circle.

10. To administer the local art and literature and film undertakings; to emphasize the creation of excellent art works, the management of these works, and cultural science and technology; to  instruct and coordinate important local cultural events.

To administrate and coordinates the press and publication work of all levels of the city; to be in charge of the examination and application of the news press, publication, printing and copyright management and agencies; to be in charge of the examination of all publications; to administrate the local copyright management (including that of the computer software).

To be responsible for the foreign cultural work and the cultural exchange with Hong Kong and Taiwan; to be in charge of the application and organization of the cultural exchange projects of the city; to be in charge of the exchange and cooperation with foreign countries in the areas of news publication and copyrights.

Main Responsibilities:

I. To draft and organize the implementation of pollution prevention laws, regulations and administrative measures concerning air, water, soil, noise, solid waste, toxic chemicals and motor vehicles; to formulate plans for the total discharge quantity of pollutants; to undertake the issue of licenses for importing and exporting waste used as raw materials; and to participate in the registration and management of toxic chemicals` import and export.


III. To supervise the exploitation and utilization activities of  natural resources which have an impact on the ecological environment, important ecological environmental construction and rehabilitation work of ecological destruction; to supervise and examine  environmental protection work in the natural reserves, famous scenic spots, forest parks; to supervise and examine biological diversity protection, wild animal and plant protection and wetland environmental protection work; to undertake the declaration of new national natural reserves in this city, and to be responsible for putting forward proposals on the ratification of the new municipal natural reserves to the municipal government and keep these on record; to supervise and administer the natural reserves at municipal level.


IV. To guide and coordinate the solving of major environmental problems in this city; to investigate and handle  major environmental pollution accidents and ecological destruction accidents; to coordinate  inter-regional environmental pollution disputes; to organize and coordinate pollution prevention in key areas, drainage areas and regions in this city; to be responsible for environmental supervision and administrative inspection of environmental protection; to organize the implementation of law enforcement inspection of environmental protection in the city.


V. To supervise the implementation of  national standards of environmental quality and pollutant discharge; to formulate municipal standards of environmental quality and pollutant discharge, and release them in procedures stipulated by the state; to examine the items concerning environmental protection in the master city plan; to organize and compile quality reports on municipal environment and release the environmental status bulletin; to participate in the compilation of the municipal sustainable development schema.


VI. To draft and organize the implementation of various environmental management systems; to examine and approve the environmental impact reports of municipal development construction projects according to the country`s regulations; to direct environmental integrated renovation in urban and rural areas, and to be responsible for the environmental integrated control and quantitative examination of key cities ; to supervise and administer ecological environmental protection in rural areas, and to guide the construction of ecological demonstration areas and ecological agriculture.


VII. To organize  demonstration projects of science and technology development, scientific research and technology on environmental protection; to administer the environmental management system certification and environmental symbol certification in this Province; to build and organize the implementation of environmental protection aptitude ratification system; to guide and promote the development of the environmental protection industry.


VIII. To be responsible for environmental monitoring, statistics and information; to formulate the local environmental monitoring systems and regulations; to organize the establishment and management of the provincial environmental monitoring network and environmental information network; to organize  quality monitoring of the provincial environment and supervisory monitoring of pollution sources.


IX. To implement the national fundamental principles concerning global environmental protection; to be responsible for cooperation and communication on environmental protection; to organize and coordinate the implementation of the environmental protection convention in this Province; to manage  international economic cooperation within the environmental protection system; to coordinate the projects using foreign investment related to  convention implementation; to be responsible for foreign-related environmental protection affairs as authorized by the provincial government.


X. To be responsible for the administration of  environmental radiation, radioactive waste throughout the city; to participate in the emergency treatment of nuclear accidents and environmental radiation; to conduct holistic supervision and management of pollution caused by electromagnetic radiation, nuclear technology application and exploitation of radioactive mineral resources; to implement the safety supervision of nuclear material regulation.


XI. To organize, direct and coordinate  environmental protection education and propaganda; to promote the public and nongovernmental organizations` participation in environmental protection.


XII. Main responsibilities of Hengyang Municipal Bureau of Public Security are:


1. Executing the national security guidelines, State laws, policies, regulations; leading, inspecting and undertaking the municipal public security work.


2. Analyzing and foreseeing the situation of public peace and order, in control of factors influencing or imperiling domestic safety and public security; providing important information and making suggestions on public peace and order for the municipal Party committee, municipal government and public security organs at higher levels.


3. Instructing municipal public security organs to investigate cases endangering state security, criminal cases and cases disturbing social order; administering and maintaining social peace and order according to law; organizing and coordinating investigation and dealing with serious cases and incidents.

Main Functions:
I. to implement laws, rules, regulations, guidelines and policies regarding human resources and social security; to study and draw up drafts of local rules and regulations regarding human resources and social security, and organize to implement related local rules and regulations; to draft, organize to carry out, supervise and examine the development plans and policies for the municipality’s human resources and social security;

VIII.To supervise and implement the legal standard for medical biomaterials and medical instrument products, and classified administration catalogue of such products; to examine and approve the clinic testing of medical instruments; to check the registration certificates of medical instrument products and the licenses for manufacturing and operations; to examine and supervise the implementation of the quality control criteria for medical instrument production; to conduct market supervision over medical instrument products.
 
IX. To supervise the implementation of administrative norms for drugs` non-clinical research and clinical tests, and authentication system for drug production, operation and preparation manufacture by medical institutions; to examine and release the licenses for manufacturing and operations and certificate of preparation manufacture by medical institutions.
 
X.To supervise and inspect the quality of drugs and medical instruments of their production and business operation enterprises and medical institutions and release quality bulletins periodically; to supervise the enforcement of purchasing and sales rules for prescription drugs, nonprescription drugs and decoction pieces; to investigate and punish the production and sales of counterfeit and poor quality drugs and medical instruments and other law-violating acts and the relevant responsible persons according to law; to supervise and regulate the Chinese medicinal materials business at trading markets in urban and rural areas.


XI.To supervise and manage stupefacient, psychotropics, poisons, anti-doping drugs, radioactive drugs, and specialized medical instruments according to the law; to be responsible for the supervision of adverse drug reactions and adverse medical instrument events and their re-evaluation; to examine and approve drug and medical instrument advertisements.
 
XII. To implement the qualification admittance system for professional pharmacists as well as organize qualification tests, registration and administration for them; to be responsible for the training and education of provincial professional pharmacists and relevant staff; to organize the post evaluation for medical technicians and qualification admittance system of medical workers.
 
XIII. To assist macro-control agencies in executing State policies for the food and drug industry by means of supervision and administration; to organize external exchange and cooperation in the aspect of drug supervision and administration, and the safety administration of food, health products and cosmetics.
 
XIV. To undertake other tasks assigned by the Municipal People`s Government.

Hengyang Municipal Bureau of Audit is established as an institution directly under the municipal government, with its main functions, internal structure and personnel management in accordance with the “Notice of the General Office of the CPC Central Committee and the General Office of the State Council on Printing and Distributing ‘Plan on Reform of Organs of Hengyang Municipal People’s Government’” (Heng Wei[2010] No. 4).


Main responsibilities:

I. To implement guidelines, policies, laws and regulations issued by the central, provincial and municipal governments concerning audit work, to draft relevant local regulations and rules, to draw up and to implement development plans of audit work, audit working plans for professional fields and annual audit plan, to make audit evaluation on issues concerning direct auditing, investigation and examination in accordance with law, and to make audit decisions or suggestions.


II. To supervise  the authenticity, legality and efficiency of the revenue and expenditure of the city and belonging to the scope of audit supervision as stipulated by laws and regulation, to maintain the order of finance and economy, to improve the returns of financial funds, promoting the construction of a clean government, guarantee the healthy development of national economy and society; to take responsibility for the result of audit, special auditing surveys and relevant auditing reports for the inspection on social auditing organizations, and to supervise and push forward the rectification and reform of the organizations under audit.


III. To submit to the Municipal Government and the relative units of the Municipal Government the auditing reports on the budget performance at the municipal level of the year and other financial revenues and expenditures; to submit, as entrusted by the Municipal Government, to the Standing Committee of Hengyang People`s Congress the auditing reports on the municipal budget performance and other financial revenues and expenditures, and reports on the correction and result of the problems found in the auditing;


IV. To submit to the Municipal Government the situation and result of the auditing and special auditing surveys on other issues, making public the auditing results, and reporting the auditing situations and results to relevant departments of the Municipal Government and the lower level governments of districts and county-level cities


V. To take charge of the following auditing affairs, issue auditing reports, make auditing decisions within authorization, and give suggestions on disposition and punishment to competent authorities:

1) The budget performance at municipal level and other revenues and expenditures, the budget performance, the final accounts and other financial revenues and expenditures, and the management, use and performance of special funds; the budget performance and other revenues and expenditures of the administrative departments of the economic and technological development zones, high-tech industrial development zones, export processing zones and bonded (ports/) zones.

2) The budget performance, the final accounts and other revenues and expenditures of governments of districts and county-level cities, and the transfer payment funds of the municipal finance.

3) The financial revenue and expenditure of public institutions and social organizations which receive municipal budgetary appropriations.

4) The budget performance and final accounts of construction projects wholly or partially invested by the Municipal Government.

5) The assets, debts, profit and loss of state-owned enterprises and financial institutions of the city, and of enterprises where the state-owned capital, as provided by the Municipal Government, is of holding or leading status.

6) The financial revenue and expenditure of social security funds, social donated funds and other relevant funds and capitals which are managed by departments of the Municipal Government, governments of districts and county-level cities, or by other units as entrusted by the Municipal Government and departments of the Municipal Government.

7) The financial revenue and expenditure of loans and aid projects from international organizations and foreign governments.

8) Other issues which shall be audited by the Municipal Bureau of Audit as specified by laws and regulations.


VI. To carry out financial accountability audit on the heads of the party committees and governments of districts and county-level cities, on the heads of the Municipal Party Committee, departments of the Municipal Government and units directly under the Municipal Government, and on the heads of other units which shall be audited by the Municipal Bureau of Audit according to law.


VII. To carry out special audit investigations on particular affairs relevant to the financial revenue and expenditure of the Municipality including the implementation of financial laws, regulations, rules, policies and macro-control measures, the budgetary management and the management and utilization of state-owned assets.


VIII.To examine the performance of auditing decisions in accordance with law, supervising the correction and settlement of problems found in the auditing, handling in accordance with law such issues as are relating to the submission for administrative reconsideration or litigation by the audited units on the auditing decisions, or the decisions of the Municipal Government; cooperating with relevant departments in investigating and settling relevant major cases.


IX.To guide and supervise the internal auditing of the whole city and of rural collective economy, examining relevant auditing reports issued by social auditing organizations for units audited and supervised by the municipal auditing departments.


X. To work together with governments of districts and county-level cities in leading the auditing departments in districts and county-level cities; to lead and supervising the operation of auditing departments at lower levels, organize auditing departments at lower levels in carrying out special audit or auditing investigations on particular projects, correct or d the correction of the auditing decisions by auditing departments at lower levels which violate relevant regulations, and assist the administration on the heads of auditing departments of districts and county-level cities in accordance with the officials management authority.


XI. To organize the auditing of overseas assets, debts, and profits and losses of state-owned enterprises of Hengyang and financial organizations through appropriate manner in accordance with law.


XII. To guide and spread the using of high technology in the municipal auditing system and organize the construction of the administration system and on-site auditing in the municipality; to organize the training of the professional auditing.


XIII.To undertake other tasks entrusted by the municipal government.

Hengyang Municipal Bureau of Coal Industry is established as an institution directly under the municipal government, with its main functions, internal structure and personnel management in accordance with the "Suggestions of State Department about the Complementation of Coal Mine Safety Monitoring System (Guo Ban Fa[2004] No. 79), Suggestions of Hunan Provincial Government about Further Complementation of Coal Mine Safety Monitoring System (Xiang Ban Fa[2005] NO.4) and Suggestions of Hengyang Municipal Government about the Complementation of Coal Mine Safety Monitoring System (Meeting summary of the Municipal Government[2005] NO. 13 )".
 
Main Responsibilities:

1.To investigate and formulate development strategies and mid-term and long-term plans for Hengyang`s coal industry according to relevant state guidelines, policies, laws and regulations; to investigate, draft and implement the industrial policies on developing Hengyang` s coal industry and the industrial management standards, regulations and relevant technical specifications; to investigate and provide suggestions for the rational exploitation of Hengyang` s coal resources, organize and direct their implementation.
 
2.To implement state guidelines, policies and laws, rules and regulations, and stipulations concerning the safe production of coal mines; to supervise and direct, coordinate and serve the safe production of coal enterprises.


3.To undertake the initial review of infrastructure and technical reform projects beyond the designated quota in coal enterprises and institutions, and provide suggestions for the project establishment; to be responsible for the design review, project construction management and quality supervision.


4.To supervise and inspect the value maintenance and appreciation of the state assets in the coal enterprises within the jurisdiction of Hengyang; to manage the state assets of the municipal coal enterprises and institutions.
 
5.to guide the efforts of the state-owned coal enterprises within Hengyang` s jurisdiction in turning losses into gains; to manage and allocate state financial subsidies to coal enterprises; to examine the final accounts of the immediately subordinate coal enterprises and institutions.To coordinate the coal production, manage coal reserves, examine and approve the abandonment, opening and closing of coal mines; to maintain the competition order of the industry, rectify and standardize in accordance with law the coal production and business order, examine and approve the opening of enterprises in the coal production and dealing businesses, and issue licences for coal production and dealing, as well as the certificates for qualified coalmine managers; to standardize and regulate the coal market, coordinate the implementation of transport and sales plans, and manage the railway transportation of coal, distribution and balance of the coal for power generation purposes.


6.To study, draft and organize the implementation of schemes, policies and measures for restructuring Hengyang`s coal industry, promote the structural adjustment of the coal industry, and guide the rationalization of the industrial layout; to guide the reform, reorganization and reinstitution of the state-owned and state-holding coal enterprises and institutions; to establish the modern enterprise system, and improve the corporate governance structure; to encourage enterprise mergers and bankruptcy, transforming production and re-distributing workers in the coal industry, and launch the job re-placement programme.


7.To direct and administer the payroll management system, the gross payroll, and the review and approval of retirement applications in the coal enterprises and institutions immediately subordinate to the Bureau, as well as affairs concerning the provincial old-age pension plan and the assessment of the employers` technical skills in its immediately subordinate agencies.


8.To provide follow-up services with respect to the municipal coal development funds; to direct and supervise the withdrawal from, utilization and management of the funds for keeping simple re-production in Hengyang`s township coalmines; to handle the daily routines of the Management Office of the funds, and make plans providing suggestions on the disposal of residual funds.


9.To organize foreign economic and technical cooperation and exchanges in Huengyang` s coal industry, expand the import and export trade of Hengyang` s coal industry, and open wider to outside world.


10.To acquire and analyze the state of art of coal production and safety control; to collect, analyze and publish information concerning the coal economy and market situation within and out of Hengyang, and provide information services; to handle statistical affairs in the coal industry.
 
11.To administer the staff workers of the Bureau, the leadership and senior officials of the coal enterprises and institutions immediately subordinate to the Bureau; to administer retired employees of the Bureau; to organize and direct the vocational qualification training for managers of all kinds of mines and special workers, issue certificates for qualified mine managers and special operations.


12.To undertake other assignments entrusted by the Provincial Party Committee and People`s Government.
